Terms of Sale

These Terms of Sale apply to consumer purchases made through JESSICA.shop at https://jessica.shop.

Nothing in these terms excludes or restricts mandatory rights under French or European Union law.

2. Scope

These terms apply to consumers purchasing primarily for purposes outside their trade, business, craft or profession.

3. Products

JESSICA.shop offers fun cards, greeting cards, creative paper goods and related products.

Before ordering, customers should review:

  • Product description

  • Dimensions

  • Materials

  • Design

  • Quantity

  • Available variations

  • Personalisation options

  • Price

  • Delivery estimate

Photographs are intended to represent products accurately. Minor differences may occur because of printing methods, lighting, photography or screen settings.

4. Personalised Products

Where personalisation is offered, customers must review all names, dates, messages, spelling, punctuation and design selections before submitting the order.

Production will be based on the information approved by the customer.

JESSICA.shop is responsible where the delivered product does not match the approved instructions.

The statutory withdrawal right may not apply to goods made to the customer’s specifications or clearly personalised, subject to applicable law.

5. Prices

Prices are displayed in the currency shown on the website.

The applicable price is confirmed before the customer submits the order.

Where value-added tax is legally applicable and included, the displayed consumer price includes that tax unless clearly stated otherwise.

JESSICA.shop provides free standard shipping on every order.

Any optional paid delivery service or other optional charge will be displayed before order confirmation.

6. Ordering Process

To place an order, the customer:

  1. Selects products and available variations.

  2. Enters personalisation information where applicable.

  3. Adds the products to the cart.

  4. Reviews the cart.

  5. Provides billing and delivery details.

  6. Selects an available payment method.

  7. Reviews the order summary and total.

  8. Corrects any errors.

  9. Confirms the order and obligation to pay.

Customers must provide complete and accurate information.

7. Contract Formation

After the order is submitted, the customer receives an electronic acknowledgement.

The acknowledgement confirms receipt but does not necessarily constitute final acceptance.

The sales contract is formed when JESSICA.shop accepts the order or confirms dispatch.

The contract is concluded in English. Customers should save the order confirmation and applicable terms.

8. Order Refusal or Cancellation

An order may be refused or cancelled for a legitimate reason, including:

  • Payment failure

  • Suspected fraud

  • Product unavailability

  • Unsupported destination

  • Materially incomplete information

  • Unlawful personalisation content

  • Intellectual-property concerns

  • An obvious pricing or technical error

If payment has been collected for an order that is not accepted, it will be refunded.

9. Payment

Available payment methods are displayed during checkout.

By submitting payment details, the customer confirms that:

  • The information is accurate

  • They are authorised to use the payment method

  • The payment provider may process the transaction

  • JESSICA.shop may collect the confirmed total

10. Delivery

All orders receive free standard shipping without conditions.

The estimated delivery time is:

15–20 calendar days from order confirmation.

Customers must provide an accurate delivery address.

JESSICA.shop remains responsible for proper performance of the consumer contract where required by law, including where third-party carriers are used.

11. Late Delivery

If delivery does not occur within the agreed period, the customer may request delivery within an appropriate additional period.

Where statutory conditions are satisfied, the customer may cancel the contract and obtain reimbursement.

If delivery by a particular date was an essential contractual condition, the customer may have the right to cancel without providing an additional period.

12. Transfer of Risk

For consumer purchases, risk generally transfers when the customer, or a designated third party other than the carrier, physically receives the goods.

13. Right of Withdrawal

A consumer generally has 14 calendar days after receiving eligible goods to withdraw without providing a reason.

The customer may use the website’s online withdrawal function or send a clear request to:

SaccucciSioma6147@outlook.com

The request should identify:

  • Customer

  • Order

  • Products concerned

  • Receipt date

  • Withdrawal decision

After notification, eligible goods must be returned without undue delay and no later than 14 calendar days after communicating withdrawal.

14. Withdrawal Refunds

Following a valid withdrawal, JESSICA.shop will reimburse the amounts received for the affected products.

The refund will be made without undue delay and no later than 14 calendar days after notification, subject to the lawful right to withhold reimbursement until the goods are received or evidence of dispatch is supplied.

The original payment method will normally be used.

Because standard shipping is free, no standard outbound delivery charge applies.

15. Withdrawal Exceptions

The right of withdrawal may not apply to legally excluded products, including:

  • Cards containing customer-selected names, dates or messages

  • Products made to customer specifications

  • Clearly personalised products

  • Sealed hygiene-sensitive goods after unsealing

  • Goods inseparably mixed with other goods after delivery

  • Eligible digital content supplied following valid consent and acknowledgement

An exception applies only where all legal conditions are satisfied.

16. Return Costs

For a change-of-mind withdrawal, the customer bears the direct return cost.

JESSICA.shop bears reasonable return costs where required by law, including for qualifying faulty, damaged, incorrect or non-conforming products.

17. Legal Guarantee of Conformity

Consumers benefit from the legal guarantee of conformity under Articles L.217-3 and following of the French Consumer Code.

Products must:

  • Match their description

  • Possess agreed characteristics

  • Correspond to approved personalisation instructions

  • Be suitable for normal use

  • Include agreed components

  • Meet legitimate expectations concerning quality and durability

For eligible new goods, the guarantee generally applies to a lack of conformity appearing within two years after delivery.

The consumer may generally request repair or replacement without cost.

Where statutory conditions are satisfied, the consumer may receive a price reduction or cancellation of the contract and reimbursement.

18. Hidden Defects

Under Articles 1641 and following of the French Civil Code, the seller is liable for qualifying hidden defects that make a product unsuitable for its intended use or substantially reduce that use.

The customer may return the product for reimbursement or keep it and request an appropriate price reduction.

A claim must generally be brought within two years after discovery of the defect, subject to applicable law.

19. Complaints

Complaints should first be sent to:

SaccucciSioma6147@outlook.com

Include:

  • Full name

  • Order number

  • Description of the dispute

  • Supporting documents or photographs

  • Requested remedy

JESSICA.shop will attempt to resolve complaints amicably.

20. Personal Data

Personal data is processed for ordering, personalisation, payment, fulfilment, delivery, customer service and legal compliance as described in the Privacy Policy.

Privacy requests may be sent to SaccucciSioma6147@outlook.com.

21. Force Majeure

Neither party is liable for failure caused by an event legally qualifying as force majeure under French law.

This section does not remove mandatory rights relating to refunds, non-delivery or termination.

22. Severability

If a provision is invalid or unenforceable, the remaining provisions continue to apply where legally possible.

A mandatory statutory rule replaces any incompatible provision.

23. Governing Law and Jurisdiction

These Terms of Sale are governed by French law.

Consumers residing elsewhere in the European Union or European Economic Area retain applicable mandatory protections under the law of their habitual residence.

Nothing in these terms removes a consumer’s right to bring proceedings before a court having jurisdiction under mandatory law.
